Terms & Conditions

Xtend supplies goods to its customers on its standard terms and conditions, which are set out below. By asking Xtend Computers (‘Xtend’) to provide you with a quote for the supply of goods, you agree to be bound by Xtend’s standard terms and conditions, as set out below, in the event that you order goods from Xtend.

1. Payment

You must pay Xtend the full price quoted for your order (including shipping or other freight costs, GST, and surcharges for credit card payment) on accepting Xtend’s quote. Xtend is under no obligation to dispatch goods to you until it has received payment for those goods.

2. Delivery

Xtend will ship your goods to you by road freight, unless you name an alternative method of delivery in your request for a quote. Xtend uses delivery services provided by third parties. Whilst Xtend will make every reasonable effort to send your goods to you using your nominated delivery method, it reserves the right to deliver goods by other methods if the method you have nominated is not available or not available at the price quoted within a reasonable time of receipt of your acceptance of Xtend’s quote.

3. Risk

All goods dispatched to you are at your risk from the time those goods are given into the custody of a delivery service provider. Xtend is not liable to insure any goods or shipment of goods at any time. If you wish to have your goods insured prior to dispatch and require further information from Xtend for that purpose, please contact us.

4. Cancellations, returns, refunds and exchanges

4.1. If you wish to cancel your order once you have accepted Xtend’s quotation, please contact us. Xtend reserves a complete and unfettered discretion to accept or refuse cancellation requests on a case by case basis. You agree to be liable to pay on demand any charge, cost or fee that Xtend incurs by reason of accepting your cancellation request, including but not limited to any cancellation fee levied on Xtend by its suppliers and any carriage or transport costs Xtend must pay by reason of your order.

4.2. Xtend will only refund the purchase price for goods it supplies if those goods are faulty or otherwise of unmerchantable quality, and if those goods are returned to Xtend in their entirety and in the packaging in which they were supplied, which must be intact, unmarked, and otherwise in good order.

4.3. Xtend will only exchange goods ordered if those goods are returned to Xtend in the packaging in which they were supplied, which must be intact and otherwise in good order.

4.4. You will be liable to pay all costs of returning the goods to Xtend for purposes of refund or exchange, including but not limited to transport and carrying costs and any charge or fee levied on a return or exchange by Xtend’s suppliers. If you wish to discuss a refund or exchange before dispatching your goods, please contact us.

4.5. You agree that Xtend may recover any moneys owing to it under paragraphs 4.1 to 4.4 of these terms and conditions by setting that amount off against any amount owed to you by Xtend as a result of your cancellation, return or exchange.

5. Retention of title

5.1. Notwithstanding paragraphs 1 and 3 of these terms and conditions, property in goods supplied to you by Xtend remains with Xtend until you have paid for those goods in full. If you are in possession of goods the property of Xtend and you default in making punctual payment for those or any other goods supplied by Xtend when such payment falls due, then Xtend may demand the return of any or all of its goods and you must return those goods to us with all due expedition. You acknowledge that if you fail to return any goods belonging to Xtend on demand, Xtend is entitled to retake possession of them.

5.2. Unless you have defaulted in making payment as mentioned in paragraph 5.1 of these terms and conditions, you may use goods you receive that remain Xtend’s property pursuant to paragraph 5.1 in the normal course of your business, but otherwise you must keep Xtend’s goods separate from other goods and identified as the property of Xtend. If using Xtend’s goods in the normal course of your business means that you incorporate those goods into other equipment, you hereby waive any right you may have to claim ownership of those goods on that basis.

5.3. You must allow Xtend or its agents to attend at your premises during normal business hours to exercise any right Xtend has to retake possession of its goods, and Xtend and it agents each have a right of entry on your premises for that purpose.

6. Warranties

Xtend supplies goods subject to the terms of its own suppliers’ warranties. It does not offer any warranty of its own in substitution for or in addition to its suppliers’ warranties. The terms of Xtend’s suppliers’ warranties may change from time to time, and Xtend has no responsibility to inform or notify any customer of such changes. 7. Disclaimers and limitation of liability

7.1. Xtend makes no representation or warranty that any goods it supplies are suitable for any particular purpose, and it its customers agree that they are solely responsible for determining the suitability of goods they order for their purposes.

7.2. Xtend makes no representation or warranty as to the current or continued availability of any goods or product mentioned on its website or in any other information it may publish.

7.3. Xtend does not post technical notes, product advisories, or similar notices released by manufacturers or other suppliers of the goods Xtend supplies on its website or elsewhere. If you are in any doubt as to the goods you require or the suitability of particular goods for your purposes, you should consult the manufacturer of those goods. Xtend makes no representation regarding the accuracy or completeness of any information published by manufacturers or suppliers of the goods Xtend supplies.

7.4. Xtend’s liability in respect of goods it supplies is limited to the greatest extent allowable by law. In the event that Xtend is unable to exclude liability in respect of any particular goods it may supply, its obligations in respect of such liability are limited to the resupply of equivalent goods.
